Any use of a gun is deadly force, weather you are "trying to wing" someone or kill them. Besides, police arn't trained to "wing" suspects, they are trained to use guns to stop suspects from causing death or serious bodily harm. Granted, in real life, Popeye might have gotten away with what he did, because the laws for police use of deadly force in 1971 were a lot less well defined then they are now. But under modern standards, the shooting would be considered unjustified.

First of all, Popeye couldn't see that the murderer didn't have the gun anymore; he could only see that the gun wasn't out. For all Popeye knew, Nicoli could've been turning to conceal an act of pulling out the gun. Second, you can't tell what Popeye was aiming for--he could've been trying to wing him to stop him from escaping. In any case, good for Popeye, whatever was going through his mind.

I guess Popeye must have been absent on the day of the police academy when they teach that you're not supposed to shoot unarmed suspects in the back when they run.

The R42 original systle before the MTA began to rebuilt the R42 in 1988. The R42 were rebuilt between 1988 and 1989. So some R42 were rebuilt in 1988 and some in 1989. The R42are different today. Some R42 have retried. all remaing R42 will run on the A,C,E,f and R only to repalce the remaing R32s and all R38s in 2009. The R42 are already running on the A,E. Thhe R42 has one more year to be on the J/Z lines to stay and then the R160 will takeover the J/Z lines and R42 moves to those routes to run
